1. Service Description
ONEUGC (operated by ONGAGE LTD, Israel) provides an AI-powered video generation platform that enables users to create talking-head and full-body AI video content using AI avatars, synthetic voices, and text-to-video technology. The Service integrates with third-party providers including ElevenLabs (voice synthesis), fal.ai (video generation), and Supabase (database and storage).
2. Account Registration
To access certain features, you must register an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must be at least 18 years old and provide accurate, current information. You agree to notify us immediately of any unauthorized account use at kobi6061@gmail.com.
3. Acceptable Use Policy
You may not use the Service to:
- Create deepfakes or misleading content depicting real individuals without their explicit consent
- Generate content that is illegal, harmful, threatening, abusive, harassing, or defamatory under Israeli or international law
- Infringe on intellectual property rights, trademarks, or copyrights of third parties
- Circumvent technical limitations, security measures, or access controls
- Resell, sublicense, or redistribute the Service without prior written authorization
- Engage in any activity that disrupts or interferes with the Service or its servers
4. Content Ownership
You retain full ownership of the video content you create using the Service. By using the Service, you grant ONGAGE LTD a limited, non-exclusive, royalty-free license solely to process and deliver your content as necessary to provide the Service. We do not claim ownership of your generated videos and will not use them for training AI models without your consent.
5. AI-Generated Content Disclaimer
Videos generated by ONEUGC are created using artificial intelligence. The realism and accuracy of AI-generated content may vary. ONGAGE LTD does not guarantee that AI-generated content is suitable for any particular purpose and disclaims all liability for any decisions made based on AI-generated content. You are solely responsible for reviewing and ensuring the appropriateness of content before publishing.
6. Credit System and Billing
The Service operates on a credit/subscription model. Paid plans are billed monthly in advance. Unused credits do not roll over between billing periods unless otherwise specified. All prices are displayed in USD and are exclusive of applicable taxes.
7. Refund Policy
Subscription fees are non-refundable except where required by applicable Israeli consumer protection law. If you experience technical issues that prevent use of the Service, please contact us within 14 days and we will evaluate your case. Refunds for unused credits may be granted at our sole discretion within 30 days of purchase.
8. Service Availability
ONGAGE LTD does not guarantee continuous, uninterrupted access to the Service. We may perform maintenance, updates, or changes to the Service at any time. We are not liable for downtime or interruptions caused by circumstances beyond our reasonable control, including third-party API outages (ElevenLabs, fal.ai).
9. Limitation of Liability
To the maximum extent permitted by Israeli law, ONGAGE LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total cumulative liability for any claim shall not exceed the total amount paid by you to ONEUGC in the 12 months immediately preceding the claim.
10. Intellectual Property
The ONEUGC platform, including its software, design, branding, and underlying technology, is the intellectual property of ONGAGE LTD and is protected by Israeli and international copyright law. You may not copy, modify, distribute, or create derivative works without express written permission.
11. Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or non-payment. Upon termination, your right to use the Service ceases immediately. We will retain your data for 30 days following termination, after which it will be permanently deleted.
12. Governing Law
These Terms are governed by the laws of the State of Israel. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts in Israel. If you are located outside Israel, you agree to submit to Israeli jurisdiction for all disputes related to this Service.
13. Changes to Terms
We may update these Terms at any time. We will notify registered users of material changes by email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
